Terms & Conditions

Version 1.0

These Terms and Conditions govern all electrical contracting services provided by Dylan Harrison trading as Summit Electrical Contractors to any client. By accepting a quotation or allowing works to commence, the Client agrees to be bound by these Terms.

1. The Contractor

Services are provided by Dylan Harrison trading as Summit Electrical Contractors, a sole trader based in Aylesbury, Buckinghamshire. The Contractor holds the following qualifications and certifications:

2. Quotations & Pricing

2.1 All quotations are provided in writing and are valid for 30 days from the date of issue, unless otherwise stated.

2.2 Quotations are based on the information available at the time of assessment. Where site conditions differ materially from those described, the Contractor reserves the right to revise the price accordingly.

2.3 All prices are quoted exclusive of VAT. The Contractor is not currently VAT-registered. In the event that the Contractor becomes VAT-registered during the course of a contract, the Client will be notified in writing and VAT will be applied from the registration date.

2.4 Quotations do not include third-party fees such as building control, Part P notification, parking charges, or specialist hire unless explicitly stated. These will be passed through at cost.

2.5 Call-out charges apply for reactive or emergency visits as communicated at the time of booking.

3. Acceptance of Quotation

3.1 A contract is formed when the Client confirms acceptance of a quotation in writing (including email or SMS) or permits works to commence on site.

3.2 The Contractor reserves the right to withdraw a quotation at any time prior to acceptance.

4. Payment Terms

4.1 Domestic clients: Payment is due in full upon completion of works, unless otherwise agreed in writing prior to commencement.

4.2 Commercial clients: Invoices are payable within 14 days of the invoice date, unless a separate written agreement has been made.

4.3 Deposit: For larger projects or where materials represent a significant proportion of the contract value, the Contractor may require a deposit of up to 50% prior to commencement. This will be stated in the quotation.

4.4 Late payment: Invoices not settled by the due date may be subject to interest at 8% above the Bank of England base rate per annum, calculated daily, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. The Contractor also reserves the right to suspend further works pending payment.

4.5 Retention of title: All materials supplied by the Contractor remain the property of the Contractor until payment has been received in full.

4.6 Payment methods: Bank transfer (BACS), cash, or as otherwise agreed. The Contractor does not accept payment by personal cheque unless specifically agreed.

5. Variations to Scope

5.1 Any changes to the agreed scope of works must be confirmed in writing before additional works are carried out.

5.2 Where unforeseen conditions are discovered during works (e.g. existing faults, non-compliant wiring, or concealed damage), the Contractor will notify the Client promptly and provide a revised price before proceeding.

5.3 Additional works carried out with verbal or written Client approval will be charged at the Contractor's standard rates in force at the time.

6. Contractor's Responsibilities

6.1 The Contractor will carry out all works in a professional and workmanlike manner, in accordance with BS 7671 (18th Edition IET Wiring Regulations) and all applicable legislation including the Building Regulations (Part P) where required.

6.2 The Contractor will take reasonable care to protect the Client's property during works and will leave the site in a clean and tidy condition.

6.3 Where required by law, electrical installation certificates or minor works certificates will be issued upon completion.

7. Client's Responsibilities

7.1 The Client must provide safe and unobstructed access to the areas in which works are to be carried out.

7.2 The Client must disclose any known existing faults, defects, or non-standard installations prior to commencement of works.

7.3 The Client is responsible for ensuring that any third-party works (e.g. plastering, decorating) required following electrical installation are arranged separately. The Contractor does not carry out making-good beyond minor filling unless explicitly agreed.

7.4 The Client must ensure that pets, children, and vulnerable persons are kept away from the active work area throughout the duration of works.

8. Materials

8.1 Unless otherwise agreed, the Contractor will supply all materials required to complete the works. Materials will be of suitable quality and fit for purpose.

8.2 Where the Client wishes to supply their own materials (e.g. light fittings, consumer units), these must be agreed in advance. The Contractor accepts no liability for faults arising from Client-supplied materials.

8.3 Any materials ordered specifically for a project that are subsequently not required due to Client cancellation or variation may be charged to the Client at cost.

9. Workmanship Guarantee

9.1 The Contractor guarantees all workmanship for a period of 12 months from the date of completion.

9.2 This guarantee covers defects directly attributable to the Contractor's workmanship. It does not cover:

9.3 Manufacturer warranties on materials and equipment are separate from this guarantee and subject to the manufacturer's own terms.

10. Limitation of Liability

10.1 The Contractor's total liability to the Client, whether in contract, tort, or otherwise, shall not exceed the total value of the contract under which the claim arises.

10.2 The Contractor shall not be liable for any indirect, consequential, or economic losses including but not limited to loss of profit, loss of revenue, loss of data, or business interruption.

10.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Cancellation

11.1 The Client may cancel a confirmed booking by providing at least 48 hours' notice prior to the scheduled start date, at no charge.

11.2 Cancellations with less than 48 hours' notice may be subject to a cancellation charge equivalent to the first hour's labour rate, to cover lost booking time.

11.3 Where materials have been ordered or collected specifically for the job prior to cancellation, reasonable costs for those materials may be charged.

11.4 Domestic consumers contracting for services at a distance (e.g. by phone or online) may have statutory cancellation rights under the Consumer Contracts Regulations 2013. Where applicable, the Contractor will provide written notice of these rights.

12. Health & Safety

12.1 The Contractor will comply with all applicable health and safety legislation, including the Health and Safety at Work etc. Act 1974 and associated regulations.

12.2 The Contractor reserves the right to suspend works and leave site immediately if the working environment poses an unacceptable risk to the health and safety of any person.

12.3 Where a Method Statement or Risk Assessment is required for commercial or site works, this will be provided prior to commencement.

13. Confidentiality & Data

13.1 The Contractor will handle all Client data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

13.2 Client information will only be used for the purposes of providing the contracted services, issuing invoices, and complying with legal obligations.

14. Disputes

14.1 In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation in the first instance.

14.2 If a dispute cannot be resolved directly, either party may refer the matter to a suitable alternative dispute resolution (ADR) service.

15. Governing Law

These Terms and any contract formed under them shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms supersede all previous versions. Clients should retain a copy for their records.
